This is because the disposal is commercially sensitive and the Council needs to use the urgency provisions to enable it to contract as the vendor unconditionally to reduce the risk of the purchaser withdrawing. The call-in provisions leave the Council exposed when it wishes the purchaser to be contractually bound. Due to the length of the procurement process, unless the five working day consideration and the three day call in period is waived, the contract cannot commence from 1 April 2018 . This would leave the Council without insurance from that date until the contract could be put in place, which would leave the Council exposed to insurance claims. The Council’s Monitoring Officer was made aware of the intention to use Special Urgency. The Chairman of the Growth, Environment and Resources Scrutiny Committee agreed to waive the five day consideration and 3 day call in period.
