Declarations of Interest and Whipping Declarations At this point Members must declare whether they have a disclosable pecuniary interest, or other interest, in any of the items on the agenda, unless it is already entered in the register of members’ interests or is a “pending notification “ that has been disclosed to the Solicitor to the Council. Members must also declare if they are subject to their party group whip in relation to any items under consideration.

Exclusion of the Press and Public To determine whether the press and public should be excluded from the meeting for discussion of Appendix A of Item 4, ‘Save Bretton Oak Tree’ Petition – Action to be Taken on the grounds that it contains sensitive information under:
- Paragraph 1 of Part 1 of Schedule 12A to the Local Government Act 1972 – information relating to any individual - Paragraph 3 of Part 1 of Schedule 12A to the Local Government Act 1972 – information relating to the financial or business affairs of any particular person (including the authority holding that information).
The public interest test has been applied to the information contained within this exempt annex, and it is considered that the need to retain the information as exempt outweighs the public interest in disclosing it. The report is exempt as it relates to data provided to the Council as part of an ongoing insurance claim and therefore the Council is only able to use that data for the purposes of dealing with the claim and cannot make it public. In addition, the report provides advice on the Council’s liability and therefore also has litigation privilege. |
