During her opening statement, the Chairman advised all present of the procedure to be followed.  There were no apologies for absence, no declarations of interest and no objections were made to any of the Members of the Sub Committee taking part in the Hearing. 

 

There were no objections to the recommended 10 minute speaking time.

The Licensing Enforcement Officer informed the Committee that it had before it an application for a new premises licence made by Mr J Guerriero who already held a personal licence.  The application was for:

 

·         Sale of alcohol for consumption off the premises

Monday to Sunday    06.00 to 24.00 (Midnight)

 

·         Recorded Music inside the premises

Monday to Sunday    06.00 to 24.00 (Midnight)

 

·         Hours premises are open to the public

Monday to Sunday   06.00 to 24.00 (Midnight)

 

 

Representations had been received from 2 interested parties under the public nuisance, crime and disorder and public safety licensing objectives.  The conditions proposed by the applicant were detailed in paragraph 6of the committee report.  However, the representations from Interested Parties had not been resolved. 

 

Councillor Goldspink addressed the committee as a Ward Councillor and Interested Party and informed members that there was a high level of disorderly behaviour related to alcohol on Eastfield Road.  Incidents had increased in the last few years as indicated in the incident sheet from Cambridgeshire Constabulary.  There were already several premises in the surrounding area selling alcohol and local residents were intimidated when going out in that area.  The level of rubbish and detritus, as well as human waste, left in the street was high.  Customers were regularly seen queuing at 6am to purchase alcohol at existing premises and this indicated the problems with alcohol consumption in the local area.

         

          The Panel had no questions to ask Councillor Goldspink.

 

          The Legal Officer advised that although Miss Coviello, another Interested Party, had not attended the hearing, her written submission should still be considered when deliberating.

         

The sub-committee retired to consider the application.

 

 

RESOLVED: to grant the application for the Premises Licence for Ruticia to be valid from 9 February 2009 subject to:

 

1.      The current conditions as set out at paragraph 6 of the committee report, with an amendment to the hours for the sale of alcohol for consumption off the premises.

 

CONDITIONS

 

1.   The hours of operation under this licence shall be:

 

      (i)   Sale of alcohol for consumption off the premises - Monday to Sunday 09.00 to 21.00.

                   (ii)  Recorded Music inside the premises - Monday to Sunday 06.00 to 24.00 (Midnight).

      (iii) Hours premises are open to the public - Monday to Sunday 06.00 to 24.00 (Midnight).
