Apologies for Absence

Minutes:

Apologies for absence were received from Councillors Allen, Saltmarsh and Miners.

 

Councillor Swift was in attendance as a nominated substitute.

Declarations of Interest and Whipping Declarations

At this point Members must declare whether they have a disclosable pecuniary interest, or other interest, in any of the items on the agenda, unless it is already entered in the register of members’ interests or is a “pending notification “ that has been disclosed to the Solicitor to the Council.

Members must also declare if they are subject to their party group whip in relation to any items under consideration.

         The Regulatory Officer introduced the report and advised the Committee that an application had been submitted by Angels 2004 Ltd, for a sexual entertainment venue licence for Angels, Earlham House, Brook Street, Peterborough.

 

         Members were requested to determine the application and it was advised that the Council had passed a resolution in 1983 to apply Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 to its area and it had laid down criteria for consideration before such a licence was issued to a premises.

        

         On 16 June 1983 the Environmental Health Services Committee determined that applications would be considered by the Licensing Panel and that a number of criteria be considered in the determination of an application for a licence for a sex establishment. These criteria were outlined in the committee report.

 

        Angels had held a premises licence issued under the Licensing Act 2003 since August 2005 and the premises had the authority under the premises licence for ‘table side’ dancing since the grant of the licence. There had been specific conditions placed on the premises licence to ensure adherence to the licensing objectives. These had also been offered up by the Applicant as conditions to be placed on the sexual entertainment venue licence, if granted. These conditions were outlined within the application form as appended to the committee report.

 

        Members were advised that the persons responsible for the management of the establishment were given as Mr Balbinder Singh, Mr Christopher Webb, Mr Rinaldo Fasulo and Mr David Keetley and the application requested trading 24 hours a day between Monday to Sunday.

 

An advertisement had been placed in the Peterborough Evening Telegraph on 21 June 2012by the Applicant containing details of the application, and stating that representations should be made to the Council within 21 days.  A similar notice had been displayed on the premise for a period of 21 days.

 

Cambridgeshire Constabulary had been consulted with and had made no representations against the granting of the renewal licence.

 

Mr Stephen McGregor, the Applicant’s Solicitor and Mr David Keetley were present. They responded to questions from Members and outlined the application in further detail. Comments and responses to questions included:

 

·         There had been no previous issues relating to the premises;

·         The 24 hour licence had been applied for in order to mirror the premises licence. This would not mean that the premises would be open for 24 hours at any point, however the granting of a 24 hour licence would allow for flexibility should it be required;

·         The conditions were outlined and it was advised that they were strictly adhered to at all times;

·         There had been no complaints received against the premises during seven years of operation.

 

Following questions to Mr McGregor and Mr Keetley, Members positively commented on the past management of the premises.

 

                   RESOLVED:

 

         The Committee approved the sexual entertainment venue licence for Angels.
