Award of Insurance Contract - MAR18/CMDN/113

Decision maker:  Cabinet Member for Resources

Decision:   14 Mar 2018

Lead officer:  Steve Crabtree

Decision status:  Recommendations Approved

Notice of proposed decision first published: 18/08/2017

Reason for urgency:
This decision is urgent as the Council’s current insurance arrangements come to an end on 31 March 2018 and the new insurance contract has to be in place for 1 April 2018. Due to the length of the procurement process, unless the five working day consideration and the three day call in period is waived, the contract cannot commence from 1 April 2018 . This would leave the Council without insurance from that date until the contract could be put in place, which would leave the Council exposed to insurance claims.

The Council’s Monitoring Officer was made aware of the intention to use Special Urgency.

The Chairman of the Growth, Environment and Resources Scrutiny Committee agreed to waive the five day consideration and 3 day call in period.

Anticipated restriction: Part exempt  - view reasons

Explanation of anticipated restriction:
The attached exempt annex is NOT FOR PUBLICATION in accordance with paragraph 3 of Schedule 12A of Part 1 of the Local Government Act 1972 in that it contains information relating to business and financial affairs, namely details of the prices submitted by unsuccessful bidders.
The public interest test has been applied to the information contained within the exempt annex and it is considered that the need to retain the information as exempt outweighs the public interest in disclosing it because to disclose it could prejudice the Council in any future procurement of these services.

Disposal of freehold in North West of the City - FEB18/CMDN/110

Decision maker:  Cabinet Member for Resources

Decision:   February 2018

Lead officer:  Jane McDaid

Decision status:  Recommendations Approved

Notice of proposed decision first published: 10/11/2017

Reason for urgency:
With the approval of the Chairman of the Growth, Environment and Resources Scrutiny Committee Special Urgency and waiver of call-in procedures have been invoked to suspend the requirement to publish the decision for 5 days prior to publication, and to suspend the 3 day call-in period.

This is because the disposal is commercially sensitive and the Council needs to use the urgency provisions to enable it to contract as the vendor unconditionally to reduce the risk of the purchaser withdrawing. The call-in provisions leave the Council exposed when it wishes the purchaser to be contractually bound.

Termination of Contracts with Carillion Construction Limited - Relating to works at Jack Hunt School Expansion Works, Hampton Garden School and St. Michael's Church School - JAN18/CMDN/88 New!

Decision maker:  Cabinet Member for Education

Decision:   January 2018

Lead officer:  Emma Everitt

Decision status:  Recommendations Approved

Notice of proposed decision first published: 29/01/2018

This decision will be taken under urgency procedures.

Reason for urgency:

If the Council does not terminate the contract as soon as possible and repossession of the site at Jack Hunt School does not take place, there are financial, health and safety and security implications. A site inspection was carried out by the Council’s representative on 16 January, which revealed that building materials had been removed from the site. There is a risk that further assets will be removed from the site (i.e site hoarding which segregates the construction site from the rest of the school site) which in turn could leave the site and the school exposed to security and health and safety risks.
The need for the decision has only come to light due to the
